When you receive a copyright infringement letter

If you are using or used images on your web site or in print or in any other media, without a photographer’s permission, and received a cease and desist letter/demand letter/copyright infringement letter from a photographer, his/her legal representative, from Getty Images or Corbis, here is a guide on what to do and what not to do in this case:

Myths about model releases

Don’t let anyone fool you. You have your right to display your photographs, publish, license and sell them without having a model release, even though the usage is somewhat limited  without one when it comes to promotional and marketing uses. If you want to secure those uses, get a model release.

Photo shoots for new clients for free*

Do you want me to shoot for you but have never worked with me before?

I decided I will make your life easier by offering “free” photo assignments. Free, until you decide to use the photos. Of course there are certain conditions the assignment has to meet. Let me go over them:

Not every assignment will be considered, I will need to discuss the project details with you and weigh its value for me. I will consider any genre, from fashion to lifestyle, product, automotive etc.

You will need to approve and sign an estimate that would include creative fees, expenses and license fees, like for a usual assignment, but my creative fees and image license fees will need to be paid only if you decide to use the images after the shoot. The license fees will reflect the particular usage and the number of images used, and can be adjusted after the assignment to meet your needs and budget.

Services of the rest of the team, including modeling and styling fees as well as any applicable location and setting expenses will have to be covered by you like in a standard assignment. You are welcome to offer your own creative team.

The bottom line: If after the shoot you are happy with the photographs and decide to use them, you get the same rate as for a standard assignment. If for some reason you are not fully satisfied or your project gets canceled before you start using the photos, you save on a great portion of the fees. I want to make sure that you get what you want before you pay for it.

I hope you’ll find this offer the most reasonable you’ve ever received and I am excited to see how it works out.

To owners of interesting photogenic locations, property, businesses

If you have property in Toronto, GTA or within 2 hrs from Toronto, that could be interesting as a photo shoot location, it could be a nicely decorated house, a cottage, a farm, a garden, or maybe you own a business, have an office, a workshop or a studio (not a commercial photo studio) that has a potential as a photo shoot location suitable for fashion, commercial, lifestyle or other concepts, and you would be interested in offering it for a photo shoot, I would appreciate if you could give me more details, its location and photos.

Please also let me know if you would be willing to offer it in exchange for photographs or prints for your personal use or for your business, or a reasonable hourly rate.

New models are always welcome

Hi there!

If you are a model or you want to be a model, or maybe you don’t want to be a model but you are a photogenic person who would like to have a professional shoot, feel free to contact me with your details and a couple of photos (headshot and full body), or a portfolio link, if you have one.

I am always interested in new faces, even if you don’t fit into my current projects, I would like to keep your info on file for future shoots. Please understand that I might not be able to answer to everybody interested, but I promise to look through all your submissions and keep the selected ones on file.

Different ethnicities are welcome. Genres I work in include fashion, beauty, glamour, body parts, erotica, lifestyle, business, health and fitness and more.

Not commissioned (creative) work will be done on TFP basis and you must be willing to sign a model release. If you are under 18, your parents must be willing to sign a model release for you.

The feast photo shoot (2010)

As soon as I posted the ‘Tea party’ photo shoot I felt it’s necessary to mention its sister shoot I’ve done in 2010. Both of them have food and fashion as the main elements of the concept, but that’s probably where the similarity ends. This is one of my most favorite photo shoots to date. I love the dramatic historic feel of it. This is where fashion and fine art meet.
